By browsing this area, the user accesses FavignanaTips.it, available at the URL favignanatips.it (hereinafter referred to as “FavignanaTips.it”). Browsing the site and submitting a purchase order imply acceptance of the Terms and Data Protection Policies adopted by the site.

These General Terms of Sale apply to the supply of services with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code (Legislative Decree no. 206/05, as amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by:

These General Terms of Sale govern the offer, submission and acceptance of purchase orders for services on FavignanaTips.it and do not govern the supply of services or the sale of products by parties other than the seller that appear on the same site via links, banners or other hyperlinks.

Before placing orders and purchasing products and services from third parties, we recommend checking their terms of sale.

To conclude the purchase contract, the electronic form must be completed and submitted by following the relevant instructions.

The form contains the reference to the General Terms of Sale, information on each service purchased, the payment methods that may be used and the conditions for exercising the right of withdrawal.

Before concluding the contract, the user will be asked to confirm that they have read the General Terms of Sale, including the information on the right of withdrawal and the processing of personal data.

The contract is concluded when the seller receives the completed form from the user, after verifying the correctness of the data contained therein.

The user will be obliged to pay the price from the moment the online order submission procedure is completed. This will be done by clicking the “Place order” button at the end of the guided procedure.

Once the contract is concluded, the seller takes charge of the order for its execution.

When completing the registration procedures, the user undertakes to follow the instructions on the site and to provide their personal data correctly and truthfully.

Once registration is completed, the user will receive a confirmation email at the address provided. Confirmation must be provided within one day at the latest. After this period, in the absence of confirmation, FavignanaTips.it will be released from any obligation towards the user.

Confirmation will in any case release FavignanaTips.it from any liability regarding the data provided by the user. The user undertakes to inform FavignanaTips.it promptly of any changes to their data at any time.

If the user provides inaccurate or incomplete data, or if there is any dispute by the interested parties regarding payments made, FavignanaTips.it reserves the right not to activate or to suspend the service until the relevant shortcomings are remedied.

Upon the user’s first request to activate a profile, FavignanaTips.it will assign a username and password. The user acknowledges that these credentials constitute the system for validating access to the Services and the only system suitable for identifying the user, and that the acts performed through such access will be attributed to them and will be binding.

The user undertakes to keep their access data confidential, to safeguard it with due care and diligence and not to transfer it, even temporarily, to third parties.

FavignanaTips.it may offer its services on trial for the duration and in the manner provided on the web page. Depending on the services offered and at its discretion, at the time of purchasing the trial services, credit card data may or may not be requested as a means of payment for the services upon expiry of the trial.

Credit card data will not be stored for the management of subsequent payments by Stripe Payments Europe, regularly certified PCI-DSS, which will provide the service on behalf of FavignanaTips.it.

Upon expiry of the trial period, the service will be deemed purchased and extended if the purchaser has not expressed their intention to withdraw before the expiry of the trial period.

In this case, upon expiry of the trial period, FavignanaTips.it will charge the amount provided for the purchase of the service to the credit card.

In cases where FavignanaTips.it has not requested credit card data at the time of the trial purchase, the provision of the service will cease at the end of the trial period. It is understood that, in the event of a trial purchase of the services, the Customer must in any case comply with the conditions provided for the individual services.

The user will have the opportunity to use a Premium service, which will be described on the site with the various packages available to the user.

The price of the services will be the price indicated from time to time on the site, except in the event of an obvious error.

In the event of an error, FavignanaTips.it will notify the purchaser as soon as possible, allowing confirmation of the order at the correct amount or cancellation. In any case, FavignanaTips.it will not be obliged to provide what was sold at the incorrectly lower price.

Prices on the site do not include VAT. Prices may change at any time. Changes do not affect orders for which order confirmation and payment have already been sent.

Shipping costs for physical products will be paid separately by the user and will vary according to the user’s cart. The user will always be informed of shipping costs at checkout.

Once the desired products and services have been selected, they will be added to the cart. It will be sufficient to follow the purchase instructions, entering or verifying the information required at each step of the process. Order details may be modified before payment.

Payment can be made by credit/debit card. Payment data must be entered at the time of the order using either a valid credit or debit card, such as Visa, Mastercard and American Express. The amount will be charged immediately, and FavignanaTips.it reserves the right to verify the validity of the card and its solvency. Following the checks, FavignanaTips.it reserves the right to refuse the order.

The following payment methods are also accepted: Bank transfer.

The services provided through the website will be delivered to the customer within the following period: 3 to 7 days and in any case within 30 days of the purchase made on the site.

The services will be usable online and sent to the email address provided by the customer at the time of purchase.

If delivery cannot take place for reasons not attributable to either party, the user will be fully refunded.

The risks relating to the products will pass to the purchaser from the moment of delivery. Ownership of the products is considered acquired as soon as full payment of all amounts due in relation to them has been received, including shipping costs, or at the time of delivery, if this takes place at a later time.

The seller is liable for any defects in the products offered on the site, including non-conformity of the items to the products ordered, in accordance with Italian law.

If the purchaser has concluded the contract as a consumer, i.e. any natural person acting on the site for purposes unrelated to any entrepreneurial or professional activity, this warranty is valid on condition that the defect appears within 12 months of the date of delivery of the products; that the purchaser submits a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognised; and that the online return form is completed correctly.

In the event of non-conformity, the user who has concluded the contract as a consumer will be entitled to have the conformity of the products restored free of charge, by repair or replacement, or to obtain an appropriate price reduction or the termination of the contract with respect to the disputed goods and the consequent refund of the price.

All return costs for defective products will be borne by the seller.

In accordance with the provisions in force, the purchaser has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 14 days pursuant to art. 52 of Legislative Decree 206/2005, starting from the date of receipt of the products.

In the case of multiple purchases made by the purchaser with a single order and delivered separately, the 30-day term starts from the date of receipt of the last product.

The user may also send an email indicating the order number and their name to the following address: info@favignanatips.it.

The purchaser must exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or, alternatively, by sending the standard withdrawal form referred to in Annex I, Part B, Legislative Decree 21/2014, which is not mandatory.

The right of withdrawal will not apply if the services and products of FavignanaTips.it fall within the categories of art. 59 of Legislative Decree 206/2005.

The site will process the refund using the same payment method chosen by the purchaser at the time of purchase. In the case of payment by bank transfer, if the user intends to exercise their right of withdrawal, they must provide the bank details: IBAN, SWIFT and BIC necessary for the refund.

The purchaser’s data are processed in accordance with the legislation on the protection of personal data, as specified in the dedicated section containing the information pursuant to art. 13 of EU Regulation 2016/679 (Privacy Policy).

If any clause of these General Terms of Sale is void for any reason whatsoever, this will not in any way affect the validity and observance of the other provisions contained in these General Terms of Sale.

These General Terms of Sale are governed by Italian law and interpreted in accordance with it, without prejudice to any overriding mandatory provision of the country of the purchaser’s habitual residence. Consequently, the interpretation, performance and resolution of these General Terms of Sale are subject exclusively to Italian law.

Any disputes relating to and/or arising from these terms will be resolved exclusively by the Italian judicial authority. In particular, if the user qualifies as a Consumer, any disputes will be resolved by the court of the place of domicile or residence of the same under applicable law.
